1. Introduction

InstAppraisal.com is owned and operated by InstAppraisal, Inc. ("InstAppraisal," "we," "us," or "our"). These Terms of Use and Privacy Policy (collectively, this "Agreement") govern your access to and use of InstAppraisal.com and related services (the "Service").

By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree, you must not use the Service.

2. Privacy Policy

2.1 Information We Collect

Account Information: Username, email address, password (stored securely), and related account details.
Appraisal Submissions: Photos, images, descriptions, metadata, and other materials you submit.
Communications: Emails or messages you send to us.
Usage Data: IP address, browser type, device information, and interaction data.
Cookies: Used for authentication, analytics, and site functionality.

2.2 Use of Information

Operate and improve the Service
Generate appraisal content
Provide customer support
Ensure security and fraud prevention
Comply with legal obligations

We do not sell personal data. Information may be shared with service providers as necessary to operate the Service or as required by law.

2.3 Data Retention

We retain submitted content and related records for operational, legal, security, fraud-prevention, auditing, and system integrity purposes. Removal from public display does not require deletion of internal records. Backup systems may retain archived copies for a limited period.

2.4 Security

We implement reasonable administrative and technical safeguards. No system is 100% secure, and use of the Service is at your own risk.

3. User Content & Public Posting

3.1 Public Nature of Submissions

Appraisal submissions are public by default. By submitting content, you understand that your appraisal pages, including images and descriptions, may be publicly displayed on InstAppraisal.com and accessible without login.

Content may be indexed, cached, archived, or otherwise stored by search engines and third parties beyond our control. We do not control third-party caching or archiving.

3.2 Ownership & License

You retain ownership of your submitted content. By submitting content, you grant InstAppraisal a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, store, reproduce, modify for formatting and compliance, publicly display, distribute, and use the content to operate, promote, and improve the Service.

3.3 AI & System Improvement

Submitted content may be processed by automated systems, including artificial intelligence tools. We may use submitted content to improve service quality, accuracy, safety, analytics, research, and platform functionality.

3.4 Removal & Deletion

InstAppraisal may, at its discretion, remove content from public display upon request. Removal from public display does not require deletion of internal records.

Once content is removed from InstAppraisal.com, it is no longer available for indexing. However, cached or archived versions maintained by search engines or third parties are outside our control.

3.5 Public Interaction

Appraisal pages may allow public interaction, including comments or replies by other users. By submitting an appraisal, you understand that other users may view, comment on, or respond to your submission.

InstAppraisal does not control third-party comments and is not responsible for user-generated responses. We reserve the right to moderate or remove comments at our discretion.

4. Nature of the Service

InstAppraisal provides informal opinions of value relating to antiques, collectibles, art, and related items.

InstAppraisal does NOT provide certified, licensed, or formal appraisals.

4.1 Authenticity Disclaimer

We do not authenticate items. Statements regarding authenticity, origin, materials, maker, or age are opinions only. Authenticity cannot be verified from photos alone.

Conditional valuations (e.g., "If Authentic" / "If Replica") are educational only.

4.2 Review Levels

Expert Reviewed

Expert review does not include forensic testing and does not guarantee authenticity.

5. User Responsibilities

You are responsible for your account credentials.
You must independently verify all appraisal information.
You assume all risk in buying, selling, or insuring items.
You may not submit illegal or infringing content.

6. Copyright & DMCA

If you believe content infringes your copyright, you may submit a DMCA notice including:

Your contact information
Identification of the copyrighted work
URL of the allegedly infringing content
Statement of good faith belief
Statement under penalty of perjury
Your signature

We may terminate repeat infringers.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTAPPRAISAL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS PAID BY YOU IN THE PRIOR 12 MONTHS, OR (B) $100 USD.

9. Indemnification

You agree to indemnify and hold harmless InstAppraisal, Inc. from claims arising from your content, use of the Service, or violation of this Agreement.

10. Time Limit to Bring Claims

Any claim arising out of use of the Service must be brought within one (1) year, or it is permanently barred.

11. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control.

12. Governing Law

This Agreement is governed by the laws of the State of California.

13. Binding Arbitration & Class Action Waiver

Disputes shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA).

You waive the right to participate in class actions or class-wide arbitration.

You may opt out within 30 days of first use by emailing [email protected].

14. Changes

We may update this Agreement at any time. Continued use constitutes acceptance.
